Data Processing Agreement for clinics

This agreement is between the vet or clinic that uses Vet mode ("the Clinic") and Mohamed Bassiuony, trading as Global Parts (جلوبال بارتس), Alexandria, Egypt, who makes Mishmish ("we"). The Clinic accepts it by ticking the box when it asks to join Vet mode. It adds to the Terms of Use.
1. Roles
For the patient list, its notes and the visits the Clinic signs, the Clinic decides why and how that data is used and is the controller; we store and move it for the Clinic and are its processor. For pet owners’ own accounts and books, and for running the app, we are the controller. A record the Clinic signs into an owner’s book also becomes part of that owner’s book.
2. The processing
- What: pet name, kind, age, weight and health history shown with a visit code; the Clinic’s notes; what the Clinic gave and signed; the owner’s account id.
- Whose: pet owners, and the Clinic’s own staff who use the account.
- Why: to let the Clinic see a pet’s book at a visit, sign what it gave, and keep its patient list.
- How long: while the Clinic’s account exists, and as set out in section 8.
3. What we promise
- Use the data only to run these Vet mode features, never for ads, and never sell it.
- Keep it confidential; only Mohamed has admin access, under the same duty.
- Protect it: encryption in transit (TLS), row level security on every table, the Clinic’s PIN for signing with a lock after wrong tries, rate limits, secret keys only on the server, daily device checks.
- Use only the listed sub-processors, each bound to protect the data, and tell the Clinic at least 14 days before adding one; the Clinic may object and leave Vet mode.
- Tell the Clinic of a breach that affects its data without undue delay and within 24 hours of learning of it, so it can meet its own 72-hour duty, and help with the follow-up.
- Help the Clinic answer requests from pet owners (access, correction, deletion).
- Give the Clinic the information it reasonably needs to check we keep this agreement.
- Transfer data outside Egypt only as the privacy policy describes, with the licence or permit of the Personal Data Protection Center where the law requires one.
4. What the Clinic promises
- Has a lawful reason to enter what it enters, tells owners about it, and keeps it accurate.
- Keeps its PIN and phone safe and signs only what it really gave.
- Follows the veterinary profession’s rules and the law.
5. Licences
Each side holds the licences and registrations its own role needs under Law 151 of 2020 and its executive regulations.
6. Liability
Each side answers for its own breach of the law and of this agreement. The limit in section 10 of the Terms applies, with the same exceptions.
7. Changes
We may update this agreement when the law or the app changes; the Clinic is asked to agree again in the app.
8. End
When the Clinic deletes its account, its patient list and notes are deleted within 30 days. Records it signed into owners’ books stay in those books, without the Clinic’s account, because they belong to the owners’ records.

اتفاقية معالجة البيانات للعيادات

هذه الاتفاقية بين الطبيب أو العيادة التي تستخدم وضع الطبيب («العيادة») ومحمد بسيوني، من خلال جلوبال بارتس (Global Parts)، الإسكندرية، مصر، مطوّر مشمش («نحن»). وتقبلها العيادة بوضع علامة في المربع عند طلب الانضمام لوضع الطبيب، وهي مكمّلة لـشروط الاستخدام.
١. الأدوار
بالنسبة لقائمة المرضى وملاحظاتها والزيارات التي توقّعها العيادة، تحدد العيادة أسباب وطريقة استخدام هذه البيانات فهي المتحكم، ونحن نخزّنها وننقلها لصالحها فنحن المعالج. أما حسابات أصحاب الحيوانات ودفاترهم وتشغيل التطبيق، فنحن المتحكم فيها. والسجل الذي توقّعه العيادة في دفتر صاحب الحيوان يصبح جزءًا من دفتره.
٢. المعالجة
- ماذا: اسم الحيوان ونوعه وعمره ووزنه وتاريخه الصحي المعروض بكود الزيارة؛ وملاحظات العيادة؛ وما أعطته ووقّعته؛ ورقم حساب صاحب الحيوان.
- بيانات من: أصحاب الحيوانات، وموظفو العيادة الذين يستخدمون الحساب.
- لماذا: لتمكين العيادة من رؤية دفتر الحيوان في الزيارة، وتوقيع ما أعطته، والاحتفاظ بقائمة مرضاها.
- المدة: طوال وجود حساب العيادة، ووفق البند ٨.
٣. التزاماتنا
- استخدام البيانات فقط لتشغيل ميزات وضع الطبيب، وأبدًا لا للإعلانات، وعدم بيعها.
- الحفاظ على سريتها؛ والوصول الإداري لمحمد فقط، بنفس الالتزام.
- حمايتها: تشفير أثناء النقل (TLS)، وأمان على مستوى الصفوف في كل جدول، ورقم PIN للعيادة للتوقيع مع قفل بعد المحاولات الخاطئة، وحدود للاستخدام، ومفاتيح سرية على الخادم فقط، وفحص يومي للأجهزة.
- الاستعانة فقط بـالمعالجين الفرعيين المذكورين، الملتزم كل منهم بحماية البيانات، وإخطار العيادة قبل إضافة أي معالج جديد بـ 14 يومًا على الأقل؛ ويحق للعيادة الاعتراض وترك وضع الطبيب.
- إخطار العيادة بأي اختراق يمس بياناتها دون تأخير غير مبرر وخلال 24 ساعة من علمنا به، لتتمكن من الوفاء بالتزامها خلال 72 ساعة، والمساعدة في المتابعة.
- مساعدة العيادة في الرد على طلبات أصحاب الحيوانات (الاطلاع والتصحيح والحذف).
- تزويد العيادة بالمعلومات التي تحتاجها بشكل معقول للتأكد من التزامنا بهذه الاتفاقية.
- عدم نقل البيانات خارج مصر إلا كما تصف سياسة الخصوصية، وبترخيص أو تصريح من مركز حماية البيانات الشخصية متى اشترط القانون ذلك.
٤. التزامات العيادة
- أن يكون لديها سند مشروع لما تُدخله، وأن تُعلم أصحاب الحيوانات به، وأن تحافظ على دقته.
- أن تحافظ على رقم PIN وهاتفها، وألا توقّع إلا على ما أعطته فعلًا.
- أن تلتزم بقواعد مهنة الطب البيطري وبالقانون.
٥. التراخيص
يحصل كل طرف على التراخيص والقيود التي يتطلبها دوره بموجب القانون رقم 151 لسنة 2020 ولائحته التنفيذية.
٦. المسؤولية
يتحمل كل طرف مسؤولية مخالفته للقانون ولهذه الاتفاقية. ويسري الحد الوارد في البند ١٠ من الشروط بنفس الاستثناءات.
٧. التغييرات
يجوز لنا تحديث هذه الاتفاقية عند تغيّر القانون أو التطبيق، ونطلب موافقة العيادة مرة أخرى داخل التطبيق.
٨. الانتهاء
عند حذف العيادة لحسابها، تُحذف قائمة مرضاها وملاحظاتها خلال 30 يومًا. أما السجلات التي وقّعتها في دفاتر أصحاب الحيوانات فتبقى فيها، بدون حساب العيادة، لأنها جزء من سجلات أصحابها.
